Imam Ali's Mathematical Brilliance: DIVIDING 17 CAMELS

A person was about to die, and before dying he wrote his Will which went as follows:

"I have 17 Camels, and I have three sons. Divide my Camels in such a way that my eldest son gets half of them, the second one gets 1/3rd of the total and my youngest son gets 1/9th of the total number of Camels."

After his death when the relatives read his will they got extremely perplexed and said to each other that how can we divide 17 camels like this.

So after a long hard thought they decided that there was only one man in Arabia who could help them: "Imam Ali (AS)."

So they all came to the door of Imam Ali (AS) and put forward their problem.

Imam Ali (AS) said, "Ok, I will divide the camels as per the man's will."

Imam Ali (AS) said, "I will lend one of my camels to the total which makes it 18 (17+1=18), now lets divide as per his will."

The eldest son gets 1/2 of 18 = 9
The second one gets 1/3 of 18 = 6
The youngest gets 1/9 of 18 = 2
Now the total number of camels = 17 (9+6+2=17)


Then Imam Ali (AS) said, "Now I will take my Camel back."


Imam Ali's Mathematical Brilliance: THE FIVE LOAVES OF BREAD


Zarr Bin Hobeish relates this story: Two travelers sat together on the way to their destination to have a meal. One had five loaves of bread. The other had three. A third traveler was passing by and at the request of the two joined in the meal.

The travelers cut each of the loaf of bread in three equal parts. Each of the travelers ate eight broken pieces of the loaf.

At the time of leaving the third traveler took out eight dirhams and gave to the first two men who had offered him the meal, and went away. On receiving the money the two travelers started quarrelling as to who should have how much of the money.

The five-loaf-man demanded five dirhams. The three-loaf-man insisted on dividing the money in two equal parts.

The dispute was brought to Imam Ali (AS) (the Caliph of the time in Arabia) to be decided.

Imam Ali (AS) requested the three-loaf-man to accept three dirhams, because five-loaf-man has been more than fair to you. The three-loaf-man refused and said that he would take only four dirhams. At this Imam Ali (AS) replied, "You can have only one dirham." You had eight loaves between yourselves. Each loaf was broken in three parts. Therefore, you had 24 equal parts. Your three loaves made nine parts out of which you have eaten eight portions, leaving just one to the third traveler. Your friend had five loaves which divided into three made fifteen pieces. He ate eight pieces and gave seven pieces to the guest. As such the guest shared one part from your loaves and seven from those of your friend. So you should get one dirham and your friend should receive seven dirhams.


Imam Ali's Answering Difficult Questions: EARS INSIDE AND OUTSIDE


One day another Jewish person came to Imam Ali (AS). He was planning to ask Imam Ali (AS) such a question, which would take Imam Ali (AS) a long time to answer and because of that his Maghrib Prayers would be delayed.

He asked, "Imam Ali you say you know everything in the world, then tell me which animals lay eggs and which animals give birth to their young ones."

Imam Ali (AS) looked back at him smiled and said, "The animals who have their 'EARS' outside their body give birth to their young ones and the animals who have their 'EARS' inside their body lay eggs."

Imam Ali (AS) was endowed with a quick, sharp, incisive, mathematical mind. Here are a few interesting stories in which Imam Ali's mathematical brilliance revealed itself.

What is a wife's share?

Imam Ali (AS) was once interrupted while he was delivering a sermon from the pulpit by someone who asked him how to distribute the inheritance of someone who had died leaving a wife, his parents and two daughters. The Imam instantly answered:

"The wife's share becomes one ninth."

How?

This answer is in fact the result of a long analysis with a number of steps. Ordinarily, we have to decide on the original share of each of these heirs, in the following way:

The wife takes one eighth, in view of the presence of an inheriting child. [Holy Quran 4:12]

The deceased's father and mother take one sixth each. [Holy Quran 4:11]

The two daughters take two thirds of the inheritance. [Holy Quran 4:11]

So the total will be: 1/8 + 1/6 + 1/6 + 2/3 = 3/24 + 4/24 + 4/24 + 16/24 = 27/24

This means the share becomes less than 1/8 in view of the increase of the total of the shares which are so fixed and prescribed. So the one eighth, the original share due to the wife out of twenty-four total shares, has become three shares out of a total of twenty-seven, which is one ninth.

Imam Ali's Mathematical Brilliance: WHOLE NUMBER AND NOT A FRACTION



One Day a Jewish person came to Imam Ali (AS), thinking that since Imam Ali thinks he is too smart, I'll ask him such a tough question that he won't be able to answer it and I'll have the chance to embarrass him in front of all the Arabs.

He asked "Imam Ali, tell me a number, that if we divide it by any number from 1-10 the answer will always come in the form of a whole number and not as a fraction."

Imam Ali (AS) looked back at him and said, "Take the number of days in a year and multiply it with the number of days in a week and you will have your answer."

The Jewish person got astonished but as he was a polytheist (Mushrik), he still didn't believe Imam Ali (AS). He calculated the answer Imam Ali (AS) gave him.

To his amazement he came across the following results:

The number of Days in a Year = 360 (in Arab)

The Number of Days in a Week = 7

The product of the two numbers = 2520

Now...

2520 ÷ 1 = 2520
2520 ÷ 2 = 1260
2520 ÷ 3 = 840
2520 ÷ 4 = 630
2520 ÷ 5 = 504
2520 ÷ 6 = 420
2520 ÷ 7 = 360

Judiciary--High Courts of India

India's judicial system is made up of the Supreme Court of India at the apex of the hierarchy for the entire country and 21 High Courts at the top of the hierarchy in each State. These courts have jurisdiction over a state, a union territory or a group of states and union territories. Below the High Courts are a hierarchy of subordinate courts such as the civil courts, family courts, criminal courts and various other district courts. High Courts are instituted as constitutional courts under Part VI, Chapter V, Article 214 of the Indian Constitution.

The High Courts are the principal civil courts of original jurisdiction in the state along with District Courts which are subordinate to the High courts.However, High courts exercise their original civil and criminal jurisdiction only if the courts subordinate to the High court in the state are not competent (not authorizied by law)to try such matters for lack of pecuniary, territorial jurisdiction. High courts may also enjoy original jurisdiction in certain matters if so designated specifically in a state or Federal law. e.g.: Company law cases are instituted only in a High court. However, primarily the work of most High Courts consists of Appeals from lower courts and writ petitions in terms of Article 226 of the Constitution of India. Writ Jurisdiction is also original jurisdiction of High Court.The precise territorial jurisdiction of each High Court varies. Each state is divided into judicial districts presided over by a 'District and Sessions Judge'. He is known as a District Judge when he presides over a civil case, and a Sessions Judge when he presides over a criminal case. He is the highest judicial authority below a High Court judge. Below him, there are courts of civil jurisdiction, known by different names in different states.

Under Article 141 of the Constitution of India all courts in India which includes High courts are bound by the judgments and orders of the Supreme Court of India by precedence.

Judges in a High Court are appointed by the President of India in consultation with the Chief Justice of India and the governor of the state. High Courts are headed by a Chief Justice. The Chief Justices are ranked #14 (in their state) and #17 (outside their state) in the Indian order of precedence. The number of judges in a court is decided by dividing the average institution of main cases during the last five years by the national average, or the average rate of disposal of main cases per judge per year in that High Court, whichever is higher.

The Calcutta High Court is the oldest High Court in the country, established on 2 July 1862. High courts which handle a large number of cases of a particular region, have permanent benches (or a branch of the court) established there. Benches are also present in states which come under the jurisdiction of a court outside its territorial limits. Smaller states with few cases may have circuit benches established. Circuit benches (known as circuit courts in some parts of the world) are temporary courts which hold proceedings for a few selected months in a year. Thus cases built up during this interim period are judged when the circuit court is in session.

भारत मे अंग्रेजों का आगमन और सत्ता पर अधिकार

भारत मे अंग्रेजों का आगमन को एक नये युग का सूत्रपात माना जा सकता है। सन् 1600 ई. में कुछ अंग्रेज व्यापारियों ने इंग्लैण्ड की महारानी एलिजाबेथ से, भारत से व्यापार करने की अनुमति ली। इसके लिए उन्होंने ईस्ट इण्डिया कम्पनी नामक एक कम्पनी बनाई। उस समय तक पुर्तगाली यात्रियों ने भारत की यात्रा का समुद्री मार्ग खोज निकाला था। उस मार्ग की जानकारी लेकर तथा व्यापार की तैयारी करके, इंग्लैण्ड से सन् 1608 में ‘हेक्टर’ नामक एक ज़हाज़ भारत के लिए रवाना हुआ। इस ज़हाज़ के कैप्टन का नाम हॉकिंस था। हेक्टर नामक ज़हाज़ सूरत के बन्दरगाह पर आकर रुका। उस समय सूरत भारत का एक प्रमुख व्यापारिक केन्द्र था।


उस समय भारत पर मुगल बादशाह ज़हाँगीर का शासन था। हॉकिंस अपने साथ इंग्लैण्ड के बादशाह जेम्स प्रथम का एक पत्र ज़हाँगीर के नाम लाया था। उसने ज़हाँगीर के राज-दरबार में स्वयं को राजदूत के रूप में पेश किया तथा घुटनों के बल झुककर उसने बादशाह ज़हाँगीर को सलाम किया। चूंकि वह इंग्लैण्ड के सम्राट का राजदूत बनकर आया था, इसलिए ज़हाँगीर ने भारतीय परम्परा के अनुरूप अतिथि का विशेष स्वागत किया तथा उसे सम्मान दिया। ज़हाँगीर को क्या पता था कि जिस अंग्रेज कौम के इस तथाकथित नुमाइन्दे को वह सम्मान दे रहा है, एक दिन इसी कौम के वंशज भारत पर शासन करेंगे तथा हमारे शासकों तथा जनता को अपने सामने घुटने टिकवा कर सलाम करने को मजबूर करेंगे।

उस समय तक पुर्तगाली कालीकट में अपना डेरा जमा चुके थे तथा भारत में व्यापार कर रहे थे। व्यापार करने तो हॉकिंस भी आया था। उसने अपने प्रति ज़हाँगीर की सहृदय तथा उदार व्यवहार को देखकर अवसर का पूरा लाभ उठाया। हॉकिंस ने ज़हाँगीर को पुर्तगालियों के खिलाफ भड़काया तथा ज़हाँगीर से कुछ विशेष सुविधाएँ तथा अधिकार प्राप्त कर लिए। उसने इस कृपा के बदले अपनी सैनिक शक्ति बनाई।

पुर्तगालियों के ज़हाज़ों को लूटा। सूरत में उनके व्यापार को भी ठप्प करने के उपाय किए। तथा फिर इस तरह 6 फरवरी सन् 1663 को बादशाह ज़हाँगीर से एक शाही फरमान जारी करवा लिया कि अंग्रेजों को सूरत में कोठी (कारखाना) बनाकर तिजारत या व्यापार करने की इजाजत दी जाती है। इसी के साथ ज़हाँगीर ने यह इजाजत भी दे दी कि उसके राज-दरबार में इंग्लैण्ड का एक राजदूत रह सकता है। इसके फलस्वरूप सर टॉमस रो सन् 1615 में राजदूत बनकर भारत आया। उसके प्रयासों से सन् 1616 में अंग्रेजों को कालीकट तथा मछलीपट्टनम में कोठियाँ बनाने की अनुमति प्राप्त हो गई।

शाहजहाँ के शासन-काल में, सन् 1634 में अंग्रेजों ने शाहजहाँ से कहकर कलकत्ते से पुर्तगालियों को हटाकर केवल स्वयं व्यापार करने की अनुमति ले ली। उस समय तक हुगली के बन्दरगाह तक अपने ज़हाज़ लाने पर अंग्रेजों को भी चुंगी देनी पड़ती थी। किन्तु शाहजहाँ की एक पुत्री का इलाज करने वाले अंग्रेज डॉक्टर ने हुगली में ज़हाज़ लाने तथा माल की चुंगी चुकाना क्षमा करवा लिया। औरंगज़ेब के शासन-काल में एक बार फिर पुर्तगालियों का प्रभाव बढ़ चुका था। मुंबई का टापू उनके अधिकार में था। सन् 1661 में इंग्लैण्ड के सम्राट को यह टापू, पुर्तगालियों से दहेज में मिल गया। बाद में सन् 1668 में इस टापू को ईस्ट इण्डिया कम्पनी ने इंग्लैण्ड के सम्राट से खरीद लिया। इसके पश्चात अंग्रेजों ने इस मुंबई टापू पर किलेबंदी भी कर ली।

सन् 1664 में, ईस्ट इण्डिया कम्पनी की ही तरह भारत में व्यापार करने के लिए फ्रांसीसियों की एक कम्पनी आई। इन फ्रांसीसियों ने सन् 1668 में सूरत में 1669 में मछलीपट्टनम में, तथा सन् 1774 में पाण्डिचेरी में अपनी कोठियां बनाई। उस समय उनका प्रधान था – दूमास। सन् 1741 में दूमास की जगह डूप्ले की नियुक्ति हुई। लिखा है-‘‘डूप्ले एक अत्यंत योग्य तथा चतुर सेनापति था। उसके पूर्वाधिकारी दूमास को मुगल शासन के द्वारा ‘नवाब’ का खिताब मिला हुआ था। इसलिए जब डूप्ले आया तो उसने स्वयं ही अपने को ‘नवाब डूप्ले’ कहना शुरू कर दिया। डूप्ले पहला यूरोपीय निवासी था जिसके मन में भारत के अंदर यूरोपियन साम्राज्य कायम करने की इच्छा उत्पन्न हुई। डूप्ले को भारतवासियों में कुछ खास कमजोरियां नज़र आईं। जिनसे उसने पूरा-पूरा लाभ उठाया।

एक यह कि भारत के विभिन्न नरेशों की इस समय की आपसी ईर्ष्या प्रतिस्पर्धा तथा लड़ाइयों के दिनों में विदेशियों के लिए कभी एक तथा कभी दूसरे का पक्ष लेकर धीरे-धीरे अपना बल बढ़ा लेना कुछ कठिन न था, तथा दूसरे यह कि इस कार्य के लिए यूरोप से सेनाएं लाने की आवश्यता न थी। बल, वीरता तथा सहनशक्ति में भारतवासी यूरोप से बढ़कर थे। अपने अधिकारियों के प्रति वफ़ादारी का भाव भी भारतीय सिपाहियों में जबर्दस्त था। किन्तु राष्ट्रीयता के भाव या स्वदेश के विचार का उनमें नितांत अभाव था। उन्हें बड़ी आसानी से यूरोपियन ढंग से सैनिक शिक्षा दी जा सकती थी तथा यूरोपियन अधिकारियों के अधीन रखा जा सकता था। इसलिए विदेशियों का यह सारा काम बड़ी सुन्दरता के साथ भारतीय सिपाहियों से निकल सकता था। डूप्ले को अपनी इस महत्त्वाकांक्षा की पूर्ति में केवल एक बाधा नज़र आती थी तथा वह थी अंग्रेजों की प्रतिस्पर्धा। ’’

डूप्ले की शंका सही थी। अंग्रेजों की निगाहें भारत के खजाने तथा यहाँ शासन करने पर लगी हुई थीं। इसका एक प्रमाण यह मिलता है कि सन् 1746 में कर्नल स्मिथ नामक अंग्रेज ने जर्मनी के साथ मिलकर बंगाल, बिहार तथा उड़ीसा विजय करने तथा उन्हें लूटने की एक योजना गुपचुप तैयार करके यूरोप भेजी थी।
अपनी योजना में कर्नल स्मिथ ने लिखा था-

“मुगल साम्राज्य सोने तथा चाँदी से लबालब भरा हुआ है। यह साम्राज्य सदा से निर्बल तथा असुरक्षित रहा है। बड़े आश्चर्य की बात है कि आज तक यूरोप के किसी बादशाह ने जिसके पास जल सेना हो, बंगाल फतह करने की कोशिश नहीं की। एक ही हमले में अनंत धन प्राप्त किया जा सकता है, जिससे ब्राजील तथा पेरु (दक्षिण अमेरिका) की सोने की खाने भी मात हो जाएंगी। “

“मुगलों की नीति खराब है। उनकी सेना तथा भी अधिक खराब है। जल सेना उनके पास है ही नहीं। साम्राज्य के अंदर लगातार विद्रोह होते रहते हैं। यहाँ की नदियाँ तथा यहाँ के बन्दरगाह, दोनों विदेशियों के लिए खुले पड़े हैं। यह देश उतनी ही आसानी से फतह किया जा सकता है, जितनी आसानी से स्पेन वालों ने अमरीका के नंगे बाशिंदों को अपने अधीन कर लिया था। “

“अलीवर्दी खाँ के पास तीन करोड़ पाउण्ड (करीब 50 करोड़ रुपये) का खजाना मौजूद है। उसकी सालाना आमदनी कम से कम बीस लाख पाउण्ड होगी। उसके प्रांत समुद्र की ओर से खुले हैं। तीन ज़हाज़ों में डेढ़ हजार या दो हजार सैनिक इस हमले के लिए काफी होंगे। “ (फ्रांसिस ऑफ लॉरेन को कर्नल मिल का पत्र)

जनरल मिल ने कुछ अधिक ही सपना देखा था। किन्तु इससे इनकार नहीं किया जा सकता कि ईस्ट इण्डिया कम्पनी के अंग्रेज भी अपने ऐसे ही मनसूबों को पूरा करने में जुटे हुए थे। दरअसल विदेशियों द्वारा भारत को गुलाम बनाने की ये कोशिशें, भारतवासियों के लिए बड़ी लज्जाजनक बातें थीं-विशेष रूप से इसलिए कि इस योजना में स्वयं भारत के लोगों ने साथ दिया तथा आगे चलकर अपने पैरों में गुलामी की बेड़ियां पहन लीं।

जनरल मिल ने लिखा है- “अठारहवीं सदी के मध्य में बंगाल के अंदर हमें यह लज्जानक दृश्य देखने को मिलता है कि उस समय के विदेशी ईसाई कुछ हिन्दुओं के साथ मिलकर देश के मुसलमान शासकों के खिलाफ बगावत करने तथा उनके राज को नष्ट करने की साजिशें कर रहे थे। अंग्रेज कम्पनी के गुप्त मददगारों में खास कलकत्ते का एक मालदार पंजाबी व्यापारी अमीचंद था। उसे इस बात का लालच दिया गया कि नवाब को खत्म करके मुर्शिदाबाद के खजाने का एक बड़ा हिस्सा तुम्हें दे दिया जाएगा तथा इंगलिस्तान में तुम्हारा नाम इतना अधिक होगा, जितना भारत में कभी न हुआ होगा। कम्पनी के मुलाज़िमों को आदेश था कि अमीदंच की खूब खुशामद करते रहो। “



कम्पनी के वादों तथा अमीचंद की नीयत ने मिलकर, बंगाल के तत्कालीन शासक अलीवर्दी खाँ के तमाम वफ़ादारों को विश्वासघात करने के लिए तैयार कर दिया। उधर कलकत्ते मे अंग्रेजों की तथा चन्द्रनगर में फ्रेंच लोगों की कोठियां बनाना तथा किलेबन्दी करना लगातार जारी था। अलीवर्दी खाँ को इसकी जानकारी थी। फिर जब उसे अमीचंद तथा दूसरे विश्वासघातकों की चाल का पता चला तो उसने उनकी सारी योजना विफल कर दी। किन्तु इन सब घटनाओं से अलीवर्दी खाँ सावधान हो गया तथा पुर्तगालियों, अंग्रेजों तथा फ्रांसीसियों-तीनों कौंमो के मनसूबों का उसे पता चल गया।

बंगाल के नवाब अलीवर्दी खाँ को कोई बेटा न था, इसलिए उसने अपने नवासे सिराज़-उज़-दौला को, अपना उत्तराधिकारी बनाया था। अलीवर्दी खाँ बूढ़ा हो चला था। वह बीमार रहता था तथा उसे अपना अंत समय निकट आता दिखाई दे रहा था। इसलिए एक दूरदर्शी नीतिज्ञ की तरह अलीवर्दी खाँ ने अपने नवासे सिराज़-उज़-दौला को एक दिन पास बुलाकर कहा-”मुल्क के अंदर यूरोपियन कौमों की ताकत पर नज़र रखना। यदि स्वयं मेरी उम्र बढ़ा देता, तो मैं तुम्हें इस डर से भी आजाद कर देता अब मेरे बेटे यह काम तुम्हें करना होगा। तैलंग देश में उनकी लड़ाइयाँ तथा उनकी कूटनीति की ओर से तुम्हें होशियार रहना चाहिए। अपने-अपने बादशाहों के बीच के घरेलू झगड़ों के बहाने इन लोगों ने मुगल सम्राट का मुल्क तथा शहंशाह की रिआया का धन माल छीनकर आपस में बांट लिया है। इन तीनों यूरोपियन कौमों को एक साथ कमजोर करने का ख्याल न करना। अंग्रेजों की ताकत बढ़ गई है। पहले उन्हें खत्म करना। जब तुम अंग्रेजों को खत्म कर लोगे तब, बाकी दोनों कौमें तुम्हें अधिक तकलीफ न देंगी। मेरे बेटे, उन्हें किला बनाने या फौजें रखने की इजाजत न देना। यदि तुमने यह गलती की तो, मुल्क तुम्हारे हाथ से निकल जाएगा। “

10 अप्रैल सन् 1756 को नवाब अलीवर्दी खाँ की मृत्यु हो गई। इसके बाद सिराज़-उज़-दौला, अपने नाना की गद्दी पर बैठा। सिराज़-उज़-दौला की आयु उस समय चौबीस साल थी। ईस्ट इण्डिया कम्पनी की नीतियों ने साजिशों का पूरा जाल फैला रखा था। अंग्रेज नहीं चाहते थे कि सिराज़-उज़-दौला शासन करे। इसलिए उन्होंने सिराज़-उज़-दौला का तरह-तरह से अपमान करना तथा उसे झगड़े के लिए उकसाने का काम शुरू कर दिया। सिराज़-उज़-दौला जब मुर्शीदाबाद की गद्दी पर नवाब की हैसियत से बैठा तो रिवाज के अनुसार उसके मातहतों को, वजीरों, विदेशी कौमों के वकीलों को, राज-दरबार में हाजिर होकर नज़रे पेश करना जरूरी था। किन्तु अंग्रेज कम्पनी की तरफ़ से सिराज़-उज़-दौला को कोई नज़र नहीं भेंट की गई।

कम्पनी हर हाल मे अपने व्यापारिक हितों की रक्षा और उनका विस्तार चाहती थी। कम्पनी १७१७ मे मिले दस्तक पारपत्र का प्रयोग कर के अवैध व्यापार कर रही थी जिस से बंगाल के हितों को नुकसान होता था । नवाब जान गया था कि कम्पनी सिर्फ़ व्यापारी नही थी और साथ सिराज़-उज़-दौला का नाना अलीवर्दी खाँ मरने से पहले उसको होशियार कर गया था। १७५६ की संधि नवाब ने मजबूर हो कर की थी जिस से वो अब मुक्त होना चाहता था। कम्पनी ख़ुद ऐसा शासक चाहती थे जो उसके हितों की रक्षा करे । मीर जाफर , अमिचंद, जगतसेठ आदि अपने हितों की पूर्ति हेतु कम्पनी से मिल कर जाल बिछाने मे लग गए । सिराज़-उज़-दौला कम्पनी के इस रवैये नाराज़ हो गया जिसका परिणाम प्लासी के युद्ध के रूप में सामने आया।

प्लासी का युद्ध 23 जून 1757 को मुर्शिदाबाद के दक्षिण में २२ मील दूर नदिया जिले में गंगा नदी के किनारे ‘प्लासी’ नामक स्थान में हुआ था. इस युद्ध में एक ओर ब्रिटिश ईस्ट इंडिया कंपनी की सेना थी तो दूसरी ओर थी बंगाल के नवाब की सेना. कंपनी की सेना ने रॉबर्ट क्लाइव के नेतृत्व में नबाव सिराज़ुद्दौला को हरा दिया था .किंतु इस युद्ध को कम्पनी की जीत नही मान सकते कयोंकि युद्ध से पूर्व ही नवाब के तीन सेनानायक, उसके दरबारी, तथा राज्य के अमीर सेठ जगत सेठ आदि से कलाइव ने षडंयत्र कर लिया था। नवाब की तो पूरी सेना ने युद्ध मे भाग भी नही लिया था युद्ध के फ़ौरन बाद मीर जाफर के पुत्र मीरन ने नवाब की हत्या कर दी थी। युद्ध को भारत के लिए बहुत दुर्भाग्यपूर्ण माना जाता है इस युद्ध से ही भारत की दासता की कहानी शुरू होती है|

इस युद्ध से कम्पनी को बहुत लाभ हुआ । वह आई तो व्यापार हेतु थी किंतु बन गई शासक। इस युद्ध से प्राप्त संसाधनो का प्रयोग कर कम्पनी ने फ्रांस की कम्पनी को कर्नाटक के तीसरे और अन्तिम युद्ध मे निर्णायक रूप से हरा दिया था । इस युद्ध के बाद बेदरा के युद्ध मे कम्पनी ने ड्च कम्पनी को हराया था। कम्पनी ने इसके बाद कठपुतली नवाब मीर जाफर को सत्ता दे दी किंतु ये बात किसी को पता न थी के सत्ता कम्पनी के पास है. नवाब के दरबारी तक उसे “क्लाइव का गधा” कहते थे कम्पनी के अफ़सरों ने जम कर रिश्वत बटोरी बंगाल का व्यापार बिल्कुल तबाह हो गया था इसके अलावा बंगाल मे बिल्कुल अराजकता फ़ैल गई थी।

प्लासी के युद्ध में जीत से कम्पनी को लाभ स्वरूप प्राप्त हुआ- भारत के सबसे समॄद्ध तथा घने बसे भाग से व्यापार करने का एकाधिकार, बंगाल के शासक पर भारी प्रभाव और बंगाल पर कम्पनी ने अप्रत्यक्ष सम्प्रभुता, बंगाल के नवाब से नजराना, भेंट, क्षतिपूर्ति के रूप मे भारी धन वसूली, एक सुनिश्चित क्षेत्र २४ परगना की जागीर का राजस्व मिलने लगा। बंगाल पर अधिकार व एकाधिकारी व्यापार से इतना धन मिला कि इंग्लैंड से धन मँगाने कि जरूरत नही रही ,इस धन को भारत के अलावा चीन से हुए व्यापार मे भी लगाया गया । इस धन से सैनिक शक्ति गठित की गई जिसका प्रयोग फ्रांस तथा भारतीय राज्यों के विरूद्ध किया गया । देश से धन निष्काष्न शुरू हुआ जिसका लाभ इंग्लैंड को मिला वहां इस धन के निवेश से ही औद्योगिक क्रांति शुरू हुई ।

इस घटना से एक नई राजनेतिक शक्ति का उदय हुआ। कम्पनी के हित राजनीति से जुड़ गए अऔर् वह प्रभुत्व प्राप्ति मे जुट गई। मुग़ल साम्राज्य के दुर्बलता भी साफ हो गई .कम्पनी को भारत के शासक वर्ग की चरित्र, फूट का पता लग गया। प्लासी के युद्ध के बाद सतारुध हु॥ मीर जाफ़र अपनी रक्षा तथा पद हेतु ईस्ट इंडिया कंपनी पर निर्भर था। जब तक वो कम्पनी का लोभ पूरा करता रहा पद पे भी बना रहा। उसने खुले हाथो से धन लुटाया, किंतु प्रशाशन सभांल नही सका, सेना के खर्च, जमींदारों की बगावातो से हालत बिगड़ रहा था, लगान वसूली मे गिरावट आ गई थी, कम्पनी के कर्मचारी दस्तक का जम कर दुरूपयोग करने लगे थे वो इसे कुछ रुपयों के लिए बेच देते थे इस से चुंगी बिक्री कर की आमद जाती रही थी बंगाल का खजाना खाली होता जा रहा था। हाल्वेल ने माना की सारी मुसीबत की जड़ मीर जाफर है, उसी समय जाफर का बेटा मीरन मर गया जिस से कम्पनी को मौका मिल गया था उसने मीर कासिम जो जाफर का दामाद था को सत्ता दिलवा दी। इस हेतु एक संधि भी हुई २७ सितम्बर १७६० को कासिम ने ५ लाख रूपये तथा बर्दवान, मिदनापुर, चटगांव के जिले भी कम्पनी को दे दिए। इसके बाद धमकी मात्र से जाफ़र को सत्ता से हटा दिया गया मीर कासिम सत्ता मे आ गया। इस घटना को ही १७६० की क्रांति कहते है।

मीर कासिम ने रिक्त राजकोष, बागी सेना, विद्रोही जमींदार जेसी समस्याओ का हल निकाल लिया। बकाया लागत वसूल ली, कम्पनी की मांगे पूरी कर दी, हर क्षेत्र मे उसने कुशलता का परिचय दिया। अपनी राजधानी मुंगेर ले गया, ताकि कम्पनी के कुप्रभाव से बच सके सेना तथा प्रशासन का आधुनिकीकरण शुरू कर दिया। उसने दस्तक पारपत्र के दुरूपयोग को रोकने हेतु चुंगी ही हटा दी। मार्च १७६३ मे कम्पनी ने इसे अपने विशेषाधिकार का हनन मान युद्ध शुरू कर दिया। लेकिन इस बहाने के बिना भी युद्ध शुरू हो ही जाता क्योंकि दोनों पक्ष अपने अपने हितों की पूर्ति मे लगे थे। कम्पनी को कठपुतली चाहिए थी लेकिन मिला एक योग्य हाकिम। १७६४ युद्ध से पूर्व ही कटवा, गीरिया, उदोनाला, की लडाईयो मे नवाब हार चुका था उसने दर्जनों षड्यन्त्र्कारियो को मरवा दिया (वो मीर जाफर का दामाद था और जानता था कि सिराजुदोला के साथ क्या हुआ था।)

मीर कासिम ने अवध के नवाब से सहायता की याचना की, नवाब शुजाउदौला इस समय सबसे शक्ति शाली था। मराठे पानीपत की तीसरी लड़ाई से उबर नही पाए थे, मुग़ल सम्राट तक उसके यहाँ शरणार्थी था, उसे अहमद शाह अब्दाली की मित्रता प्राप्त थी । जनवरी 1764 मे मीर कासिम उस से मिला। उसने धन तथा बिहार के प्रदेश के बदले उसकी सहायता खरीद ली। शाह आलम भी उनके साथ हो लिया। किंतु तीनो एक दूसरे पर शक करते थे। इन्हीं परिस्थितियों मे बक्सर की लड़ाई, 23 अक्टूबर 1764 में बक्सर शहर के करीब, ईस्ट इंडिया कंपनी और बंगाल के नबाब मीर कासिम, अवध के नबाब शुजाउद्दौला तथा मुगल बादशाह शाह आलम द्वितीय की संयुक्त सेना के बीच लड़ी गई थी जिसमे हैक्टर मुनरो के सेनापतित्व में अंग्रेज कंपनी ने तीनो को हरा दिया था। लड़ाई में अंग्रेजों की जीत हुई और इसके परिणामस्वरूप पश्चिम बंगाल, बिहार, झारखंड, उड़ीसा और बांग्लादेश का दीवानी और राजस्व अधिकार अंग्रेज कंपनी के हाथ चला गया ।

बक्सर के युद्ध के परिणाम बेहद मह्ताव्पूर्ण निकले। सहज ही प्रयास से पूरा अवध कम्पनी को मिल गया था। नवाब शुजाउदौला की हालत इतनी गिर गई की उसने कम्पनी के सामने आत्मसमर्पण कर दिया था (मई 1765)। शाह आलम भी कम्पनी की शरण मे आ गया था। बंगाल अब कम्पनी का अधीनस्थ राज्य बन गया, अवध उस पर आश्रित तथा मुग़ल सम्राट कम्पनी का पेंशन भोगी। ये सभी कार्य इलाहाबाद की संधि (16 अगस्त 1765) से हुआ इस के बाद बंगाल, बिहार, उडिसा, झारखण्ड की दीवानी कम्पनी को मिल गई थी। बंगाल मे द्वैध शासन शुरू हो गया। इसके बाद दिल्ली पर भी अंग्रेजों का प्रभाव और फ़िर अधिकार हो गया।

What is a Finance Commission? What functions can be assigned to a Finance Commission?

Most of the federal States have elaborate provisions of distribution of financial resources between the federal and provincial governments, as well as among the provinces. To this extent, Indian Constitution is no exception. Indian Constitution makes the distinction between the legislative power to levy a tax and the power to appropriate the proceeds of a tax so levied. There are taxes like sales tax and State excise duties, which are levied and collected by the States, while the sales tax on inter-State sale, called the central sales tax, is levied by the Central government but is assigned to the State concerned. Properties of the Union and States are exempted from mutual taxation under Article 285(1) and 289(1) of the Constitution. But there are taxes levied and collected by the Union, which are distributed between the Union and the States. These include income tax and union excise duties.

It is in relation to such taxes that Articles 270, 273, 275 and 280 of the Constitution provide for the constitution of a Finance Commission every five years, to recommend to the President of India certain measures regarding distribution of financial resources between the Union and the States. Article 280 provides that the Finance Commission shall recommend to the President the percentage of net proceeds of income tax, which should be assigned by the Union to the States, and the manner in which such a share of the States is to be distributed among them. The recommendations of the Finance Commission, when accepted, remain valid for a period of five years before which next Finance Commission is appointed.

The Chairman of the Commission, in view of the President, must be a person having experience in public affairs. In addition, four other members of the Commission with following qualifications/prerequisites are appointed:
(a) A High Court judge or anyone having qualification to be appointed as such. (b) A person having specific knowledge of finances and accounts of the government. (c) A person having vast experience of financial and administrative matters. (d)??A person having special knowledge of economics.

As per the Constitution, it is the duty of the Finance Commission to make recommendations to the President on the following:
(I) Distribution between the Union and the States, of net proceeds of taxes, which are to be distributed among them.
(II) Distribution of their share among the States.
(III) The principles governing grants-in-aid of the Union revenues to the States.
(IV) The measures to augment the resources of the States to supplement the resources of Panchayati Raj Institutions.
(V) The measures to augment the resources of the States to supplement the resources of municipalities in the States.
(VI) Any other matter referred to the Commission by the President of India.

Definitions

Though definitions vary, rape is defined in most jurisdictions as sexual intercourse, or other forms of sexual penetration, by one person ("the accused" or "the perpetrator") with or against another person ("the victim") without the consent of the victim.

The term sexual assault is closely related to rape. Some jurisdictions define "rape" to cover only acts involving penile penetration of the vagina, treating all other types of non-consensual sexual activity as sexual assault. The terminology varies, with some places using other terms. For example, Michigan, United States uses the term "criminal sexual conduct".In some jurisdictions, rape is defined in terms of sexual penetration of the victim, which may include penetration with objects, rather than body parts.Some jurisdictions also consider rape to include the use of sexual organs of one or both of the parties, such as oral copulation and masturbation.

In Brazil, the definition of rape is even more restrictive. It is defined as non-consensual vaginal sex.Therefore, unlike most of Europe and the Americas, male rape, anal rape, and oral rape are not considered to be rape. Instead, such an act is called a "violent attempt against someone's modesty" ("Atentado violento ao pudor").

In recent years, women have been convicted of raping or sexually assaulting men.[citation needed] Also, in recent years women have also been convicted of rape or sexual assault by procuring a man to rape another woman, and by being an accomplice to a rape.
Consent

In any allegation of rape, the absence of consent to sexual intercourse on the part of the victim is critical. Consent need not be expressed, and may be implied from the context and from the relationship of the parties, but the absence of objection does not of itself constitute consent.

Duress, in which the victim may be subject to or threatened by overwhelming force or violence, and which may result in absence of objection to intercourse, leads to the presumption of lack of consent. Duress may be actual or threatened force or violence against the victim or somebody else close to the victim. Even blackmail may constitute duress. The International Criminal Tribunal for Rwanda in its landmark 1998 judgment used a definition of rape which did not use the word 'consent': "a physical invasion of a sexual nature committed on a person under circumstances which are coercive."

Valid consent is also lacking if the victim lacks an actual capacity to give consent, as in the case of a victim who is a child, or who has a mental impairment or developmental disability. Consent can always be withdrawn at any time, so that any further sexual activity after the withdrawal of consent constitutes rape.

The law would invalidate consent in the case of sexual intercourse with a person below the age at which they can legally consent to such relations. (See age of consent.) Such cases are sometimes called statutory rape or "unlawful sexual intercourse", regardless of whether it was consensual or not.

In times gone by and in many countries still today marriage is said to constitute at least an implied consent to sexual intercourse. However, marriage in many countries today is no longer a defense to rape or assault. In some jurisdictions, a person cannot be found guilty of the rape of a spouse, either on the basis of "implied consent" or (in the case of former British colonies) because of a statutory requirement that the intercourse must have been "unlawful" (which is legal nomenclature for outside of wedlock).However, in many of those jurisdictions it is still possible to bring prosecutions for what is effectively rape by characterizing it as an assault.

Types

There are several types of rape, generally categorized by reference to the situation in which it occurs, the sex or characteristics of the victim, and/or the sex or characteristics of the perpetrator. Different types of rape include but are not limited to: date rape, gang rape, marital rape or spousal rape, incestual rape, child sexual abuse, prison rape, acquaintance rape, war rape and statutory rape.Men can be raped as well as women. The victim does not have to be penetrated to be raped, the perpetrator can use objects to stimulate the genitals. The perpetrator can use his hand to stimulate the genitals. The perpetrator can use drugs (roofies and others) or hypnosis to incapacitate the victim. Rape is not always done for sexual satisfaction of the perpetrator. Blackmail, punishment, curiosity, money, and power are all motives for rape as well as sex.

History


The rape of noblewoman Lucretia was a starting point of events that led to overthrow of Roman Monarchy and establishment of Roman Republic. As a direct result of rape, Lucretia committed suicide. In ancient history, rape was viewed less as a type of assault on the female, than a serious property crime against the man to whom she belonged, typically the father or husband. The loss of virginity was an especially serious matter. The damage due to loss of virginity was reflected in her reduced prospects in finding a husband and in her bride price. This was especially true in the case of betrothed virgins, as the loss of chastity was perceived as severely depreciating her value to a prospective husband. In such cases, the law would void the betrothal and demand financial compensation from the rapist, payable to the woman's household, whose "goods" were "damaged".Under biblical law, the rapist might be compelled to marry the unmarried woman instead of receiving the civil penalty if her father agreed. This was especially prevalent in laws where the crime of rape did not include, as a necessary element, the violation of the woman's body, thus dividing the crime in the current meaning of rape and a means for a man and woman to force their families to permit marriage. The word rape itself originates from the Latin verb rapere: to seize or take by force. The word originally had no sexual connotation and is still used generically in English. The history of rape, and the alterations of its meaning, is quite complex. In Roman law, rape was classified as a form of crimen vis, "crime of assault."Unlike theft or robbery, rape was termed a "public wrong" iniuria publica as opposed to a "private wrong" iniuria privita.Augustus Caesar enacted reforms for the crime of rape under the assault statute Lex Iulia de vi publica, which bears his family name, Iulia. It was under this statute rather than the adultery statute of Lex Iulia de adulteriis that Rome prosecuted this crime.Emperor Justinian confirmed the continued use of the statute to prosecute rape during the 6th century in the Eastern Roman Empire.By late antiquity, the general term raptus had referred to abduction, elopement, robbery, or rape in its modern meaning. Confusion over the term led ecclesial commentators on the law to differentiate it into raptus seductionis (elopement without parental consent) and raptus violentiae (ravishment). Both of these forms of raptus had a civil penalty and possible excommunication for the family and village receiving the abducted woman, although raptus violentiae also incurred punishments of mutilation or death.

From the classical antiquity of Greece and Rome into the Colonial period, rape along with arson, treason and murder was a capital offense. "Those committing rape were subject to a wide range of capital punishments that were seemingly brutal, frequently bloody, and at times spectacular." In the 12th century, kinsmen of the victim were given the option of executing the punishment themselves. "In England in the early fourteenth century, a victim of rape might be expected to gouge out the eyes and/or sever the offender's testicles herself."

The medieval theologian Thomas Aquinas argued that rape, though sinful, was much less unacceptable than masturbation or coitus interruptus, because it fulfilled the procreative function of sex, while the other acts violated the purpose of sex.

During the Colonization of the Americas, the rape of native women was not held to be a crime under Spanish Law as the persons in question were Pagan and not Christian.

The modern criminal justice system is widely regarded as unfair to sexual assault victims.Both sexist stereotypes and common law combined to make rape a "criminal proceeding on which the victim and her behavior were tried rather than the defendant".Additionally, gender neutral laws have combated the older perception that rape never occurs to men,while other laws have eliminated the term altogether.

Since the 1970s many changes have occurred in the perception of sexual assault due in large part to the feminist movement and its public characterization of rape as a crime of power and control rather than purely of sex. In some countries the women's liberation movement of the 1970s created the first rape crisis centers. One of the first two rape crisis centers, the D.C. Rape Crisis Center, opened in 1972. It was created to promote sensitivity and understanding of rape and its effects on the victim. In 1960 law enforcement cited false reporting rates at 20%. By 1973 the statistics had dropped to 15%. After 1973 the New York City Police Department used female officers to investigate sexual assault cases and the rate dropped to 2% according to the FBI. (DiCanio, 1993).

Male-male rape has historically been shrouded in secrecy due to the stigma men associate with being raped by other men. According to psychologist Dr Sarah Crome fewer than one in ten male-male rapes are reported. As a group, male rape victims reported a lack of services and support, and legal systems are often ill equipped to deal with this type of crime.

Most legal codes on rape do not legislate against women raping men, as rape is generally defined to include the act of penetration on behalf of the rapist.[citation needed] In 2007 the South Africa police investigated instances of women raping young men.





Dowry deaths are the deaths of young women who are murdered or driven to suicide by continuous harassment and torture by husbands and in-laws in an effort to extort an increased dowry. Dowry deaths are reported in various South Asian countries such as India, Pakistan, and Bangladesh. Dowry death is considered one of the many categories of violence against women in South Asia.

Most dowry deaths occur when the young woman, unable to bear the harassment and torture, commits suicide. Most of these suicides are by hanging, poisoning or by fire. Sometimes the woman is killed by setting her on fire; this is known as "bride burning", and sometimes disguised as suicide or accident. According to Indian police, every year it receives over 2,500 reports of bride-burning, while human rights organisations in Pakistan report over 300 deaths per year.The Indian National Crime Records Bureau (NCRB) reports that there were about 6787 dowry death cases registered in India in 2005.[citation needed] Incidents of dowry deaths during the year 2005 (6,787) have increased significantly by 46.0 per cent over 1995 level (4,648).[citation needed]

'The 1961 Dowry Prohibition Act' prohibits the request, payment or acceptance of a dowry, "as consideration for the marriage". where "dowry" is defined as a gift demanded or given as a precondition for a marriage. Gifts given without a precondition are not considered dowry, and are legal. Asking or giving of dowry can be punished by an imprisonment of up to six months, or a fine of up to Rs. 5000. It replaced several pieces of anti-dowry legislation that had been enacted by various Indian states.Indian women's rights activists campaigned for more than 40 years to contain dowry deaths without much success. The Dowry Prohibition Act 1961 and the more stringent Section 498a of IPC (enacted in 1983) did not achieve the desired result. Using the Protection of Women from Domestic Violence Act 2005 (PWDVA) implemented in 2006, a woman can put a stop to the dowry harassment by approaching a domestic violence protection officer. Due to demands by women's rights activists, the Indian government has modified property inheritance laws and permitted daughters to claim equal rights to their parental property. Some religious groups have urged the people to curb the extravagant spendings during the marriages.
